The thesis of this article is that through a number of state court opinions & legislative action by way of living will statutes, the United States is in a posture in which active euthanasia is a logical next step. However, the author argues that step is one which neither judiciary or legislature is likely to take without the initiative of the people. He concludes that individual choice is the real issue & that physician’s aid in dying fairly represents the will of the people in the United States.
