Berman discusses the term “standard of care” which arises in US court cases when it is believed that a physician has failed to fulfill his responsibilities for a patient (e.g. in the case of a patient’s suicide). Berman notes 3 problems: the definition of “standard of care” is vague; that often it is not expert opinion, but rather the attributes of an attorney, that can sway a jury’s favor; and that having “standard of care” places stress on caregivers and their actions when treating a patient.
