Discusses the legal implications of jail suicides based on the courts’ increasing willingness to hear wrongful death suits & to impose duties upon custodians. Standards of care focus on the duty to detect suicide risk which involves environmental considerations as well as the status of the detainee. The instititutional capacity to respond to suicide is examined. As standards of care continue to evolve, the legal exposure of custodians to detect or screen suicide risk should continue or expand.
